Dear Shamiram;

As Persi clearly answered your questions first, I will not post my response (even though I wrote it last night) as it will be redundant. However, I would like to just add that one non "tactical" disadvantage in the summary judgment is that the presiding judge over the case may completly miss the issues involved in the case due to its complexity (no offence Persi (humor)) and hand down an unfavorable decsion to the party that brought forth the motion for summary judgment. I think you know of a similar pending case.
